Adidas suing THQ over contract breach, late to deliver fitness game

THQ does not have much good news to speak about lately, but that has not stopped Adidas kicking them when they are down – and suing them for a breach of contract.

The lawsuit, which was filed earlier this week, on Wednesday, cites than THQ has failed to provide “miCoach” – a new Adidas branded fitness game – in the allotted time the company agreed to in a contract back in 2010.

Adidas are asking for $10.6 million in damages, along with an injunction to stop THQ selling the “miCoach” licence. Adidas instead want them to transfer the licence to another developer (of Adidas’ choosing) with THQ getting no financial gain out of the transaction. The fitness game was supposed to be on store shelves by, at least, January 2012.

THQ really are having a bad time right now, with multiple layoffs, a complete restructuring of its business, and a threat of Nasdaq delisting looming over their heads in recent months, so this could not have came at any worse of a time for the company. The miCoach game was one of the games believed to be affected by these recent layoffs.
